V. Draw and Awarding of Prizes
1. The prizes will be awarded as follows:
The Grand Prize for participants 18 and older and the prize for a hockey game in the National Hockey league’s Stanley Cup finals will be drawn from all the duly registered individual, family and team participants in Quebec.
The family prize and the team prize will be drawn from the registered families and teams respectively and will be presented to the representatives responsible for the family and the team.
A regional prize for each of the following regions will be drawn from the participants:
- Bas-Saint-Laurent
- Saguenay—Lac-Saint-Jean
- Capitale Nationale (Quebec city)
- Mauricie et Centre-du-Québec
- Estrie
- Montréal
- Outaouais
- Abitibi-Témiscamingue
- CĂ´te-Nord
- Nord-du-Québec, Nunavik et Terres-Cries
- Gaspésie—Îles-de-la-Madeleine
- Chaudière-Appalaches
- Laval
- Lanaudière
- Laurentides
- Montérégie
The random draws for the twenty (20) potential winners will take place on April 8, 2010 at 9:00 AM (EST), at 300 rue Léo-Pariseau, suite 1810, City of Montreal, Province of Quebec. The prizes will be drawn in the following order: Grand Prize for participants 18 and older, the prize for a hockey game in the National Hockey League’s Stanley Cup finals, the Desjardins Health Challenge Family Prize and the regional prizes.
3. Potential winners will be contacted by telephone starting on April 12, 2010, by the members of the eligibility committee, in order to answer a questionnaire designed to verify the eligibility criteria for the 5/30 Health and Wellness Challenge contest listed in Section II of the present rules. Potential winners will not be informed of their status as potential winners nor of the nature of the eligibility criteria verification.
4. If the potential winner cannot be reached after three (3) days of attempts, at the rate of two (2) calls per day (72 hours after the first call), if there is no response or no callback after a message has been left on the individual’s voicemail, the potential winner will not have the right to a prize. In this case, the next potential winner on the list will be called. No delay may go beyond 72 hours from the time of the first call, for whatever reason.
5. To be declared a winner and receive a prize, potential winners must first demonstrate by their answers in the telephone interview that they have taken up the 5/30 Health and Wellness Challenge in their own way to improve health during the six (6) weeks of the 5/30 Health and Wellness Challenge, that is from March 1 to April 11, 2010 inclusive. Potential winners will be taken at their word and presumed to be in good faith. Second, potential winners will have to correctly answer, without assistance, within a given time, a skill-testing mathematical question asked over the telephone at a time previously agreed to by the parties.
6. The potential winner of the Grand Prize for participants 18 and older will not be eligible for the prize of the hockey game in the National Hockey League’s Stanley Cup finals or for the regional prizes, but will be eligible for the Family prize provided the eligibility conditions for that prize category are met.
7. The potential winner of the prize of the hockey game in the National Hockey League’s Stanley Cup finals will not be eligible for the regional prizes, but will be eligible for the Family Prize provided the eligibility conditions for that prize category are met.
8. The potential winners of the Family Prize will not be eligible for the regional prizes, but will be eligible for the other prizes as long as they respect the eligibility conditions for these prize categories.
9. In the case of the Desjardins Health Challenge Family Prize, the family representative will be declared the potential winner and will be contacted to verify his/her participation as well as that of the family members.
10. The team prize for the Montreal Canadiens game at the Bell Centre will be offered as a participation prize among all heads of teams in the 5/30 Health and Wellness Challenge. The three (3) random draws of the winners will take place on March 9, 2010, at 9:00 AM (EST), at 300 rue Léo-Pariseau, suite 1810, City of Montreal, Province of Quebec.
11. After having reached the potential winners and having verbally confirmed, with witnesses, their eligibility for the 5/30 Health and Wellness Challenge prizes, the organizers will supply, individually to all the potential winners, a written declaration attesting to the respect of the conditions set out in the present rules, as well as a waiver.
12. Said declaration must be read and signed by the potential winner. The potential winner must return one copy by fax to the organizers of the draw and send the original, duly signed, by mail within the prescribed deadline. If the deadline is not respected, the potential winner will be disqualified. A parent or guardian must sign the declaration of a potential winner who is a minor.
13. In the event of a person whose name was drawn not satisfying the requirements of the present rules, he/she will be automatically disqualified, and the prize will be awarded to a new participant by random draw, according to the same eligibility criteria.
14. ACTI-MENU is the initiator of the 5/30 Health and Wellness Challenge, and is solely responsible for the organization of the draws, which are done using a very strict process and supervised by a committee made up of internal representatives involved in producing the 5/30 Health and Wellness Challenge. This committee is called the “eligibility committee.”
15. Prizes must be accepted as awarded and described in the present rules for the 5/30 Health and Wellness Challenge. They are not transferable and may not be replaced by other prizes, nor are they exchangeable, in whole or in part, for cash or other goods. ACTI-MENU reserves the right to substitute a prize of an equivalent value for a prize that cannot be awarded as described in the present rules.
16. The chances of winning depend on the number of registrations received during the registration period.
17. The public health departments that offer special prizes are subject to provincial rules governing the 5/30 Health and Wellness Challenge. The draws will be performed by the Challenge organizers who supervise the draws for the provincial and regional prizes. The confirmation of winners is the responsibility of each of the public health departments, and ACTI-MENU undertakes to submit the list of winners and prizes awarded to the Régie des alcools, des courses et des jeux.
